TERMS AND CONDITIONS

1. About Us

These Terms and Conditions govern the supply of services by SMA Marble Ltd (Company Number: 15965812), a company registered in England and Wales.

Throughout these Terms, “we”, “our”, and “us” refer to SMA Marble Ltd, while “you” and “the Customer” refer to the person or organisation purchasing our products or services.


2. Our Services

We provide professional stone supply, fabrication and installation services, including but not limited to:

  • Quartz Worktops

  • Granite Worktops

  • Marble Worktops

  • Porcelain Worktops

  • Dekton Worktops

  • Stone Splashbacks

  • Bathroom Stone Surfaces

  • Fireplace Surrounds

  • Commercial Stone Projects

  • Stone Repairs and Restoration


3. Quotations

All quotations are provided free of charge.

Unless otherwise stated:

  • Quotes remain valid for 30 days from the issue date.

  • Prices are based on the information available at the time of quotation.

  • Final pricing may change if measurements, specifications or project requirements change before fabrication.

  • Additional work requested after acceptance of the quotation may be charged separately.

A quotation does not constitute a binding contract until accepted by both parties.


4. Orders

An order is considered accepted once:

  • the quotation has been accepted,

  • any required deposit has been received,

  • and we have confirmed your booking.

After acceptance, materials may be ordered and production scheduled.


5. Deposits and Payment

A deposit may be required before work begins.

Unless otherwise agreed:

  • Remaining balances are payable immediately upon completion of installation.

  • Ownership of supplied materials remains with SMA Marble Ltd until payment has been received in full.

Late payments may result in delays to future work and recovery action where necessary.


6. Site Access

The Customer agrees to provide safe and reasonable access to the property for:

  • Survey visits

  • Laser templating

  • Delivery

  • Installation

  • Inspection

Failure to provide suitable access may result in additional charges or rescheduling.


7. Templating

Template measurements are taken based on the site conditions existing at the time of measurement.

The Customer must ensure:

  • Cabinets are fully installed and level.

  • Appliances are available where required.

  • Plumbing and electrical work affecting measurements has been completed.

Any changes made after templating may require new measurements and additional charges.


8. Fabrication

Once fabrication has started:

  • Design changes may not be possible.

  • Additional manufacturing costs may apply.

  • Lead times may change.


9. Installation

Installation dates are estimates only.

Completion times may vary due to:

  • Site conditions

  • Weather

  • Supplier delays

  • Traffic

  • Health and safety requirements

  • Unforeseen circumstances

We will always make reasonable efforts to complete installations as scheduled.


10. Natural Stone

Natural stone products including marble, granite, quartzite and onyx contain natural characteristics.

Variations in:

  • colour

  • veining

  • pattern

  • movement

  • texture

  • fossil marks

  • mineral deposits

are normal and do not constitute defects.

Each slab is unique.

Samples and photographs are intended only as a general guide.


11. Engineered Stone

Quartz, porcelain and other engineered materials may display minor variations between batches.

Colours shown in brochures, websites or samples may differ slightly from the finished installation due to manufacturing tolerances and lighting conditions.


12. Existing Worktops

Removal of existing worktops is only included where specifically stated in the quotation.

Where removal is requested:

  • we will take reasonable care,

  • however existing worktops, splashbacks, cabinets, walls, tiles or decorations may become damaged during removal.

We cannot guarantee damage-free removal of existing installations.


13. Customer Responsibilities

The Customer is responsible for ensuring:

  • unrestricted site access;

  • completed cabinetry before templating;

  • suitable structural support;

  • safe working conditions;

  • removal of fragile or valuable items from the work area;

  • adequate parking where required.

Delays caused by the Customer may incur additional charges.


14. Cancellations

Orders may be cancelled before fabrication begins.

Deposits may be retained to cover:

  • administration costs;

  • purchased materials;

  • surveys;

  • templating;

  • design work already completed.

Once fabrication has started, cancellation charges may apply up to the full contract value where costs have already been incurred.

Nothing in these Terms affects any statutory cancellation rights available under the Consumer Contracts Regulations 2013 where applicable.


15. Delays Beyond Our Control

We shall not be liable for delays caused by events outside our reasonable control, including but not limited to:

  • supplier shortages;

  • manufacturing delays;

  • transport disruption;

  • severe weather;

  • strikes;

  • utility failures;

  • government restrictions;

  • force majeure events.


16. Warranty

We take pride in the quality of our workmanship.

Any workmanship issues reported within a reasonable period following installation will be inspected and, where appropriate, remedied.

This warranty does not cover:

  • accidental damage;

  • misuse;

  • impact damage;

  • chemical damage;

  • excessive heat;

  • structural movement;

  • misuse of the surface;

  • damage caused by third parties.

Manufacturer warranties for materials remain subject to the relevant manufacturer’s own terms.


17. Limitation of Liability

Nothing within these Terms excludes liability for:

  • death or personal injury caused by negligence;

  • fraud;

  • any liability that cannot legally be excluded under the laws of England and Wales.

To the fullest extent permitted by law, our liability for any claim relating to our services shall not exceed the total amount paid by the Customer under the relevant contract.

We shall not be liable for indirect, consequential or business losses.


18. Intellectual Property

All content displayed on this website including:

  • photographs;

  • logos;

  • graphics;

  • text;

  • designs;

  • layouts;

remains the property of SMA Marble Ltd unless otherwise stated.

No material may be copied or reproduced without prior written permission.


19. Website Information

While we make reasonable efforts to keep website information accurate, we do not guarantee that descriptions, colours, dimensions or specifications are entirely free from errors.

We reserve the right to amend website content without prior notice.

21. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
